This Privacy Policy describes how The Law Office of Tom De Kesel, LLC (“the firm,” “we,” “us,” or “our”) handles personal information through dekesellaw.com and communications initiated through the website. It does not replace duties that apply to client files after an attorney-client relationship is formed. Client information may also be governed by professional-conduct rules, confidentiality duties, engagement agreements, and applicable law.

If you call, email, send a WhatsApp message, or schedule a consultation, you may provide your name, contact information, appointment preferences, and a general description of the legal matter. Please provide only the information reasonably necessary to request contact or schedule an appointment.

Website and device information

Our hosting and security providers may automatically receive technical information such as an Internet Protocol address, browser and device type, requested pages, referring page, and date and time of access. This information may be used for security, troubleshooting, site operation, and aggregate performance measurement.

Sensitive information

Immigration or citizenship status and certain identifiers may be considered sensitive personal data under applicable law. The public website does not ask you to submit this information. If the firm agrees to evaluate or represent you, the office will explain an appropriate method for providing necessary documents and case details.

4. When Information May Be Disclosed

We may disclose information to vendors that support website hosting, information technology, security, scheduling, communications, document management, billing, and professional services. Relevant services may include Cal.com for scheduling and WhatsApp/Meta if you choose to communicate through WhatsApp. These providers operate under their own terms and privacy practices.

Information may also be disclosed with your direction or consent; to courts, immigration agencies, co-counsel, experts, interpreters, or other participants when needed for an accepted legal matter; to comply with law or professional duties; or to protect legal rights and safety. Nothing in this policy is intended to waive attorney-client privilege, work-product protection, or professional confidentiality.

5. Sale, Targeted Advertising, and Profiling

The firm does not sell personal information, share it for cross-context behavioral advertising, or process it for targeted advertising. The firm does not use personal information to profile individuals in furtherance of decisions that produce legal or similarly significant effects. We retain information only for as long as reasonably necessary for the purposes described above and to meet legal, ethical, insurance, accounting, and recordkeeping requirements. Retention periods vary depending on whether an inquiry becomes a client matter. We use reasonable administrative, technical, and physical safeguards, but no website, email system, messaging platform, or method of electronic storage is completely secure.

7. Privacy Choices and Requests

Depending on where you live and whether a particular privacy law applies, you may have rights to confirm whether personal data is processed; access or obtain a portable copy; correct inaccuracies; delete certain data; and opt out of sale, targeted advertising, or qualifying profiling. The firm does not discriminate against a person for exercising an applicable privacy right.

When the Texas Data Privacy and Security Act applies, the firm will respond without undue delay and generally within 45 days, subject to permitted extensions.

If a request is denied, you may appeal by emailing the same address with the subject “Privacy Appeal.” If an appeal is denied and Texas law applies, you may submit a privacy complaint to the Texas Attorney General. Even where an exemption applies, including a small-business exemption, the firm may voluntarily consider reasonable requests.

9. Children’s Privacy

This website is intended for a general audience and is not directed to children under 13. The firm does not knowingly collect personal information from a child under 13 through this public website. A parent or legal guardian seeking immigration assistance for a child should contact the office without sending sensitive documents through the website.

We may update this policy to reflect changes in law, technology, vendors, or firm practices. The effective date at the top identifies the latest published version. Material changes will be posted on this page.
